# Acceptable Use Policy ("AUP")

GUIDANCE NOTES - This Acceptable Use Policy is a set of rules and guidelines that govern the proper use of a system, service, or platform. It defines the boundaries of acceptable behavior, establishes the rights and responsibilities of users, and outlines the consequences for non-compliance.

Please read this Acceptable Use Policy carefully before accessing or using the Digital Design Brief service. By accessing or using the Digital Design Brief service, you acknowledge that you have read, understood, and agree to comply with this Acceptable Use Policy.

  1. This Acceptable Use Policy (AUP) outlines the terms and conditions that govern the acceptable use of the Digital Design Brief software ("the Service," "we," "us," or "our"), which is exclusive intellectual property of Arup IP Limited ("Arup"). The Service includes:
    1. any site associated with the https://ddb.arup.com subdomain
    2. any affiliated Digital Design Brief website (used for documentation, support, or additional information).
    3. any software developed by Arup for use in conjunction with Digital Design Brief (plugins, connectors, dashboards, etc).
    4. any other media form, website, or application related, linked, or otherwise connected to Digital Design Brief.
  2. By accessing and using the Service, you agree to comply with this AUP. Failure to comply with these guidelines may result in the limitation or termination of your access to the Service. If you do not agree with all the terms included in this AUP, then you are prohibited from using the Service and must discontinue immediately.

# Authorised Use

  1. Access to the Service is limited to authorised parties only (Users). Users:
    1. must have valid credentials and may not share their login information with others.
    2. must use the Service solely for the purposes outlined in the agreement between the user's organization / contracting authority and Arup.
    3. are responsible for ensuring the security of their account and must report any suspected unauthorised access immediately.
    4. must be at least 16 years of age.
    5. must review and agree to the Acceptable Use Policy prior to using the Service.

# Application Programming Interface (API) and Software Development Kit (SDK) Terms

  1. If any client deploys DDB through the medium of its own application or web interface, the client shall ensure that the deployment displays to Users (with comparable prominence and branding to that used by Digital Design Brief; Arup IP Limited) the statement "Powered by Digital Design Brief" (or other such statement or branding as may be approved by Arup IP Limited).   1. Abuse or excessively frequent requests to our servers via the API may result in the temporary or permanent suspension of your account's access to the API. We, in our sole discretion, will determine abuse or excessive usage of the API. We will make a reasonable attempt to warn you via email prior to suspension.
  2. You may not use the API to download data from the Service for spamming purposes, including for the purposes of selling the Service users' personal information, such as to recruiters, headhunters, and job boards.
  3. All use of the Service API is subject to this Acceptable Use Policy and our Privacy Policy.

# Prohibited Activities

  1. Users shall not engage in any:
    1. activities that violate applicable laws, regulations, or third-party rights while using the Service.
    2. malicious or disruptive activities, including but not limited to hacking, transmitting malware, or interfering with the performance of the Service.
  2. Users must not:
    1. use the platform to store, transmit, or distribute any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
    2. attempt to gain unauthorised access to other Users' accounts, data, or the underlying infrastructure of the Service.
    3. use their personal information or the personal information of others as the parameter, asset, value, source, name, unit, or other user-controlled storage mechanism on the Service.
    4. use any third-party service providers in conjunction with the Service without the appropriate license or permit. All applicable policies of the third-party service must be adhered to.

# Data Confidentiality, Security, and Privacy

  1. Users must protect the confidentiality, integrity, and availability of data stored or processed through the Service.
  2. Users shall not access, disclose, or use any data within the platform, except as explicitly permitted or required for their authorised use.
  3. Users must take appropriate measures to protect the confidentiality, integrity, and security of data when sharing information outside of the Service, such as through published reports or APIs.
  4. Users shall comply with all applicable data protection and privacy laws and regulations when using the Service.
  5. Users are responsible for verifying that the data being inputted into the Service is not bound by any restrictions that are not satisfied by the Service. This includes restrictions related to data residency, data transfer, and confidentiality.

# Intellectual Property

  1. The Service is the exclusive intellectual property of Arup.
  2. Users shall respect the intellectual property rights of the Service provider and any third parties.
  3. Users must not copy, distribute, modify, or create derivative works of the Service or any related materials, except as explicitly permitted.
  4. Our intellectual property may not be used in connection with any product, application, or platform without our prior written consent.
  5. Users must not use the Service for the purpose of creating a similar and/or competitive product to Digital Design Brief. We reserve the right to suspend or cancel user subscriptions without warning if this term is violated.

# System Usage

  1. Users must not engage in activities that may degrade the performance or stability of the Service or its associated infrastructure.
  2. Users shall not use the Service for excessive or unnecessary resource consumption.
  3. Users must report any issues or vulnerabilities discovered within the platform to Arup immediately.

# Feedback

  1. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Service ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.

# Termination

  1. Arup reserves the right to limit, suspend or terminate User access to the Service in the event of a violation of this AUP.
  2. Users will be held liable for any damages, losses, or legal consequences arising from their non-compliance with this AUP.

# Amendments

  1. Arup may revise this AUP at any time. Users will be notified of any changes to the AUP, and continued use of the Service after such notification constitutes acceptance of the revised AUP.
  2. By accessing and using the Service, you acknowledge that you have read, understood, and agree to comply with this Acceptable Use Policy.
